Family
residence permit in Turkey
In
Articles 341 to 37 of the Aliens and International Protection Act No.6458, the
provisions of the Family Residence Permit are laid down.
Also, in
Articles 30 and 34 of the Implementing Regulations of the Law on Foreign
Nationals and International Protection, the rules on family residence permits
are laid down.
Which
foreigners are granted family residence permits?
In the case of Turkish citizens, persons who
are subject to Article 28 of Law No. 5901 or who have one of the types of
residence permit and asylum seekers and holders of secondary protection status;
A) his
foreign spouse,
(B) an
international child under eighteen years of age or his or her spouse,
(C) An
international child in need of his or her spouse’s or his / her spouse’s family
residence permit will be allowed.
If a
foreigner applying for a family residence permit has more than one spouse, only
one spouse will be granted a family residence permit.
However,
all foreigners’ children will be issued a residence permit. Applying for a
family residence permit for children, if the father or mother has the right to
custody abroad, consent is required.
Family
residence permits, up to the age of eighteen, without the need for a student
residence permit.
Foreign
nationals holding family residence permits may apply for a short-term residence
permit in the following circumstances:
In case of
divorce of a person who has been married to a Turkish citizen and resided with
a family residence permit for at least three years, but from persons found to
be a victim of domestic violence by court order, a residence permit for a
period of three years No family will ask.
A person
residing in Turkey with a Residence Permit to reside in the case of a deceased
backup,
Persons
who have lived in our country for at least three years with a family residence
permit and have reached the age of eighteen years,
How long
can a family residence permit be?
Family
residence permits can be adjusted for a maximum of three years at any time.
Under no
circumstances can a family residence permit be more than a patron’s residence
permit.
What are
the requirements for a residence permit?
To apply
for a family residence permit, foreigners must meet the requirements outlined
in Article 35 of the Act.
Instead of
bringing the terms requested by the sponsor
Supporter;
having valid health insurance that covers all family members, having monthly
income so that each family member’s share is not less than one-third of the
minimum wage; Who has been affected by the family order has not committed,
resided in Turkey for at least one year and his address is registered in the
address registration system.
Instead of
providing the conditions for people who have applied for family residency
intending to stay with the sponsor,
Providing
supporting documents and information regarding the purpose of staying in the
country, showing intention to live with designated persons and the nature of
their lives, above the age of eighteen of his or her spouse, subject to Article
7 of the said Act, not being married for the sole purpose of obtaining
residence.
Reasons
for denial, revocation, or non-renewal of family residence permit?
Unless the
requirements for a family residence permit are fulfilled or eliminated,
If it is
established that the family residence permit has been used for purposes other
than the purposes of the residence permit,
If there
is a deportation order or a ban on entry,
Under
these circumstances, no family residence permit will be granted, and if issued,
it will be canceled and will not be renewed if it expires.
